channel in the UK for Sikhs. The Channel broadcasts
educational and religious programs and does not distribute any surplus funds or profit to owners or shareholders, but instead use them to help pursue
their goals and objectives. This covers their broadcast running costs and any surplus
is used to produce new programming for the Sikh community.

Summary of Ofcom’s investigation: In July
2009, Ofcom received six complaints from viewers about appeals for
funds broadcast on the Sikh Channel. In summary, the complainants
were concerned that: the money raised during the appeals was not
being used for the purpose described, and that the on-air
description of the broadcaster as a ‘not-for-profit’ company was
inaccurate and could mislead viewers who were making donations to
the channel.
Funds were used purely for the running of
the Channel
Ofcom conducted a detailed assessment of the
documentary evidence it requested from the licensee. It also took
into account submissions made by a firm of chartered accountants
employed by the licensee. Ofcom did not find any specific evidence
that the funds raised by the appeals were used for any purpose
other than to fund the running of the channel.
Expenditure was in excess of that raised
by donations
This conclusion was supported by the
chartered accountants whose review did not identify any misuse of
funds and also indicated that expenditure on the channel was in
excess of that raised by donations.
Ofcom did not therefore find a breach of the
Code in respect of this area of its investigation. However, Ofcom
was concerned about the disorganised presentation of the
accounting information provided by the licensee, which did not
assist the investigation.
Ofcom considers this issue to be resolved
The licensee has since demonstrated to Ofcom
that it has taken steps to improve its record-keeping, and
consequently Ofcom considers this issue to be resolved.
Separately, Ofcom considered that on balance, the description of
the broadcaster as a ‘not-for-profit’ company was not in breach of
the Code.
